If this is assumed to be true, is it not illiberal to try to justify principles of justice, which can be regarded as the subject of an unending collective deliberation? I suggest that it is not, using an analogy with scientific progress. Moreover, I try to show that Rawls's achievement is misunderstood if one forgets that it is supposed to overcome the antinomy between “la liberte des Modemes” and “la liberte des Anciens.” In this respect, I insist on some unnoticed similarities between Rawls's and Popper's points of views. I conclude on the idea of the “neutrality” of the theory of justice, suggesting a link between Rawls's approach and the French republican tradition. read more read less

However, human beings are naturally subject to periods of dependency, and people without disabilities are only "temporarily abled." Instead of seeing assistance as a limita- tion, we consider it to be a resource at the basis of a vision of society that is able to account for inevitable dependency relationships between "unequals" ensuring a fulfilling life both for the carer and the cared for.** 1. Preface People with disabilities continue to suffer from discrimination in jobs, education, and housing, and are deprived of capabilities as basic as the freedom to move about. Even in aspects of life such as friendships, disabled people, especially if they are cognitively disabled, find themselves excluded (Reinders, 2008). The source of that self-designation is that his conception of democracy—what he calls “discursive democracy”—is founded on the ideal of “a self-organizing community of free and equal citizens,” coordinating their collective affairs through their common reason. The source of that self-designation is that his conception of democracy—what he calls “discursive democracy”—is founded on the ideal of “a self-organizing community of free and equal citizens,” coordinating their collective affairs through their common reason. The author discusses three large challenges to this radical-democratic ideal of collective self-regulation: 1) What is the role of private autonomy in a radical-democratic view? 2) What role does reason play in collective self-regulation? 3) What relevance might a radical-democratic outlook have for contemporary democracies? The author addresses these questions by considering Habermas' answers, and then presenting alternative responses to them. The alternatives are also radical-democratic in inspiration, but they draw on a richer set of normative-political ideas than Habermas wants to rely on, and are more ambitious in their hopes for democratic practice. read more read less

The relation in the two cases between these premisses and the ensuing legal result is, however, different. The Subsumption Formula is represented by a scheme that works according to the rules of logic, the Weight Formula, by a scheme that works according to the rules of arithmetic.
